TERMS AND
CONDITIONS OF SALE ORDERING:
Customer by initialing order form, has
accepted responsibility for approving the type, size, fabrication, and
quantity of glass to be ordered. All orders, which have not been cut,
fabricated, or special ordered, may be cancelled or sizes changed
without penalty to customer. If the raw glass has been cut or fabricated
the customer will be billed for the product.
ACCEPTANCE: Seller CANNOT
ASSUME any liability for breakage or surface abnormalities (rubs or
scratches) after glass has been received by customer, or picked up by a
commercial carrier. PRICES: All prices subject to change without notice.
Odd or fractional inches will be charged at the next higher even inch.
TOLERANCES: All glass cutting subject to industry standard tolerance.
PRODUCTION TIME: Once an order has been received, ABACA GLASS & MIRROR
will cut and fabricate the order as quickly as possible in the order as
received. Special orders or edge work will require additional time.
Seller shall not be liable for any costs incurred by the customer or for
special, indirect, incidental, or consequential damages to anyone by
reason of any delay in performance or failure to deliver material within
the time limit specified by the customer or stated by the seller.
PACKAGING OF GLASS AND MIRRORS: With the customer’s request, small
pieces of glass (24” x 36 “ or less) and Framed Mirrors will be wrapped
in 20# White Paper at no additional charge. Big pieces of glass above
24" x 36” will be sold without a protective covering; However, boxing of
the glass with a wooden crate is recommended and is available for an
additional charge.
LOADING OF MERCHANDISE: Customer assumes all
liability for loading of the merchandise. ABACA GLASS & MIRROR will
assist the customer as directed, but will reserve the right to refuse
loading of materials we deem to be unsafe. Delivery of materials may be
purchased for additional charge.
SHIPMENTS: ABACA
GLASS & MIRROR IS NOT RESPONSIBLE FOR DAMAGE
OR INJURY WHILE GLASS IN TRANSIT. Transporting of merchandise will be at purchaser’s
risk. Seller shall not be liable for any cost incurred by a customer or
for special, direct, indirect, incidental or consequential damages to
anyone by any reason, due to customers improper handling or loading of a
broken or unbroken product. Delivery of materials may be purchased for
additional charge. (See your sales representative) No claims for
breakage allowed after signing for delivery of articles in good order.
STORAGE: ABACA GLASS & MIRROR is not responsible for articles left over
night against theft and damage. Any articles left over 30 days will be
sold for storage charges.
WARRANTIES: Seller warrants that its
merchandise meets standard industry specifications and will be free from
material defects in manufacturing and fabrication. ABACA GLASS & MIRROR.
MAKES NO OTHER WARRANTY, EXPRESSED OR IMPLIED.
CUSTOMER’S GLASS AND
MERCHANDISE: ABACA GLASS & MIRROR shall not be liable for any damage to,
or theft of, a customer’s personal property which has been left for
fabrication or to assist in fabrication of a product. The customer’s
exclusive remedy and the limit of the seller’s liability for any loss or
damage resulting from defective goods or from any other cause, shall be
limited to replacement of the defective material, F.O.B. seller’s plant,
or at the seller’s option, to refund the purchase price. The seller
shall not be liable for any incidental or consequential damages in
breakage.
CASH ORDERS: All cash orders require 50% down and a balance on
receiving the product. There is a minimum charge of $5.00 on all cash
sales. ALL returned checks are subject to a maximum penalty charge as
allowed by law.
CREDIT ORDERS: All orders shall be subject to approval
by ABACA GLASS & MIRROR credit department. Orders will not be entered
into processing until credit approval is obtained. Major credit cards
are NOT ACCEPTED except through PayPal.. There is a minimum charge of
$10.00 on all charge tickets. Terms of payment shall be 1% CASH DISCOUNT
IF PAID WITHIN 10 DAYS OF NOTICE DATE, regardless of delivery date.
There will be no cash discount on freight or boxing charges allowed in
delivery prices. NET DUE 10 DAYS. A late charge of 1 ½ % per month. (18%
per year) will be assessed on all past due accounts.
CUSTOMER’S
ACCEPTANCE OF CONDITIONS: Customer’s consent to the terms and conditions
of ABACA GLASS & MIRROR are presumed upon customer’s order as specified
above. No additions to or modifications of these terms are valid unless
in writing and signed by an officer of ABACA GLASS & MIRROR. |
